Terms & Conditions

These Terms & Conditions apply to bookings and participation in courses, events, experiences and activities provided by Jonathan Holland trading as Devon and Cornwall Bushcraft (“we”, “us” or “our”). Please read them before booking. By making a booking, the person making the booking confirms that they have read and accepted these terms and, where booking for a group, will make the relevant terms, joining information and safety requirements available to all participants.

1. About us and insurance

Devon and Cornwall Bushcraft provides bushcraft and survival courses and events, including axe throwing and archery, and demonstration stands for trade shows. We are insured as Jonathan Holland T/A Devon and Cornwall Bushcraft under policy ABC-POL-002300 with NPA Insurance Ltd t/a Peach, arranged through Activity Business Cover. The current policy period is 30 May 2026 to 29 May 2027.

Our current cover includes Employers’ Liability with a limit of indemnity of £10,000,000 and Public and Products Liability with a limit of indemnity of £5,000,000, subject to the policy terms, conditions, excesses and exclusions. Insurance details may change at renewal and evidence of current cover is available on reasonable request.

2. Making a booking

A booking is not confirmed until we have accepted it and any payment or deposit due at the time of booking has been received. Your booking confirmation, quotation or event information may contain additional terms specific to that activity. The person making a group booking must be aged 18 or over, provide accurate information and ensure participants receive joining instructions and relevant safety information.

3. Prices and payment

Prices are those stated at the time of booking or in a written quotation. Deposits, balances and payment dates will be shown during booking or on the quotation or invoice. Bespoke bookings may include agreed costs for specialist instructors, venue hire, travel, materials or catering.

4. Customer cancellations, transfers and non-attendance

Unless different cancellation terms were clearly agreed for a bespoke booking, our standard cancellation policy is: more than 30 days before the activity – 100% refund; between 15 and 30 days before the activity – 50% refund; 14 days or fewer before the activity – normally non-refundable.

Cancellation charges are intended to reflect losses and costs arising from cancellation. Where we can resell a place or otherwise reduce our loss, we will take that into account where required by applicable consumer law. Transfer requests will be considered where practical. Failure to attend, or arriving too late to participate safely, will normally be treated as a customer cancellation. Nothing in these terms affects statutory rights.

4A. Online bookings and statutory cancellation rights

Where you book online, by telephone or otherwise at a distance, consumer cancellation rights may apply. However, the statutory 14-day cancellation right does not normally apply to contracts for leisure activities where the contract provides for the activity to take place on a specific date or during a specific period. Where that exception applies, the cancellation terms in section 4 will apply from the time the booking is confirmed. Nothing in these terms removes any statutory cancellation right that does apply to your booking.

4B. Transfers and substitutions

If you cannot attend, you may ask to transfer the booking or substitute another suitable participant. Any transfer or substitution requires our prior agreement and may be refused where it would affect safety, staffing, age restrictions, insurance requirements or the nature of the activity. A replacement participant must meet all participation requirements and complete any required medical, suitability, parental/guardian or safety documentation before taking part. Reasonable unavoidable costs arising from a transfer may be charged where applicable.

5. Changes or cancellation by us

Outdoor activities can be affected by weather, ground conditions, instructor availability, access restrictions, fire risk and circumstances outside our reasonable control. We may make reasonable changes to timings, instructors, activity order, location within a venue, equipment or content where necessary for safe and effective delivery.

If we cancel an activity and cannot provide a suitable alternative that you accept, payments made to us for that activity will be refunded. We are not responsible for separate travel, accommodation or other costs except where the law provides otherwise.

Where a refund is due, we will normally return it using the original payment method within 14 days after we confirm that the refund is payable, unless another method is agreed.

5A. Minimum participant numbers

Some public courses and events require a minimum number of participants to run safely or viably. Where a minimum number applies and is not reached, we may cancel or reschedule the activity. We will give as much notice as reasonably practicable and offer affected customers a transfer to a suitable alternative date or a refund of payments made to us for the cancelled activity. We recommend that customers consider refundable or flexible travel and accommodation arrangements, as we are not responsible for separate costs except where the law provides otherwise.

6. Weather and outdoor conditions

Normal British weather is part of an outdoor experience. Rain, cold, heat, mud or wind will not automatically result in cancellation. Participants must arrive with suitable clothing and footwear. We may alter, postpone or cancel where conditions create an unacceptable safety risk, including severe weather, high winds, flooding, extreme heat, wildfire risk or restrictions imposed by a landowner or authority.

7. Inherent risks, safety briefings and participant declarations

Bushcraft and outdoor activities involve inherent risks. Depending on the activity these may include fire, smoke, sharp tools, knives, axes, saws, archery equipment, uneven or slippery ground, falling branches, adverse weather, plants, fungi, insects, animals, water, lifting and other natural hazards. Some activities can result in serious injury or death if undertaken incorrectly or if safety instructions are ignored.

We risk assess the activities we provide and use appropriate instruction, supervision and safety procedures, but it is not possible to remove every risk from an outdoor environment. Participants must attend and follow the safety briefing, act responsibly, use equipment only as instructed and immediately tell an instructor if they do not understand an instruction or feel unable to continue safely.

Essential safety briefings form part of participation. A participant who arrives after an essential briefing has begun or finished may be required to wait for an appropriate separate briefing or may be refused participation where the instructor considers that allowing them to join would create an unacceptable safety risk. This is particularly important for activities involving fire, knives, axes, saws, archery, game preparation or other potentially hazardous tools or techniques.

As a condition of participation, we may require each participant to complete and sign a participant declaration confirming that they have received a safety briefing, understand the nature and risks of the activity, agree to follow instructions, and have disclosed information relevant to their suitability to participate. For participants under 16, the required forms must be completed or countersigned by a parent or guardian.

Nothing in these terms excludes or restricts our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or restricted.

8. Suitability to participate, medical information and accessibility

Participants must complete any health questionnaire or suitability-to-participate declaration we require before taking part. Participants, parents/guardians and group organisers must disclose relevant existing injuries, medical conditions, allergies, disabilities, medication or additional needs that may affect safe participation or require an adjustment. Information must be accurate and updated if circumstances change.

Disclosure does not automatically prevent participation. We will consider reasonable adjustments where practicable, but an instructor may modify or refuse participation in an activity where, after considering the circumstances, participation cannot reasonably be made safe. Relevant health information is handled as special-category personal data in accordance with our Privacy Policy.

9. Children and young people

Age limits and supervision requirements vary by activity. For anyone under 16, we require the parent or guardian documentation specified for the activity, including the insurer-required parental/guardian indemnity and countersignature of participant suitability and risk declarations where applicable.

For schools, Scouts, youth groups and similar bookings, responsibility for pastoral care, behaviour management and appropriate adult supervision remains with the organisation unless expressly agreed otherwise. Our instructors remain responsible for safe delivery and instruction of the activities we provide.

10. Behaviour, alcohol and drugs

Anyone who is visibly intoxicated or appears to have taken drugs that may impair safe participation will not be permitted to participate. Participants must follow reasonable safety instructions and respect instructors, other participants, the venue, wildlife and equipment.

We may stop participation or require a person to leave for a genuine safety concern, serious misconduct, threatening or abusive behaviour, deliberate damage or repeated refusal to follow safety instructions. Where removal results from the participant’s own serious misconduct, a refund will not normally be due.

11. Instructors, equipment and PPE

Activities are supervised by trained and experienced instructors. Where a relevant National Governing Body qualification exists, instructors/leaders will hold the appropriate qualification or have been assessed by an appropriately qualified technical adviser; where no relevant qualification exists, instructors/leaders will have appropriate training, assessment or experience for the activity concerned.

Equipment is checked as appropriate and must be used in accordance with instruction and manufacturers’ recommendations. Participants must wear or use any Personal Protective Equipment required for the activity. A participant who refuses required PPE or safety equipment may be unable to continue.

11A. Personal tools, equipment and items made during activities

Where participants bring their own knives, axes, tools or other equipment, they must ensure that possession, transport and use are lawful and that the items are suitable for the activity. We may prohibit the use of personal equipment that an instructor considers unsuitable or unsafe. Participants are responsible for the lawful possession, transport, storage and subsequent use of any knife, axe, cutting tool, bow, projectile, flint-knapped item or other tool or object that they take away from an activity or make during a course. Instruction provided during an activity does not authorise possession or use contrary to applicable law.

12. Subcontractors

Where bona fide subcontractors are used to deliver activities, we require appropriate evidence of Public Liability Insurance covering the activities they perform and meeting the insurance requirements applicable to our policy. Activities delivered on a subcontracted basis remain subject to appropriate risk assessment and supervision arrangements.

13. Camping and overnight activities

Where camping forms part of an event, participants are responsible for suitable sleeping equipment unless accommodation is expressly provided. Woodland and wild-camping ground may be uneven, wet, root-covered or limited in open space. Fires, stoves and cooking equipment may only be used in permitted areas and in accordance with instructions, venue rules and temporary fire restrictions.

14. Food, foraging and allergies

Activities may include food preparation, wild food, game preparation, cooking or communal meals. Participants must tell us in advance about allergies, intolerances and dietary or medical requirements. Although reasonable care will be taken, outdoor and communal cooking environments may not be suitable for guaranteeing an allergen-free environment.

Wild plants, fungi or other foraged items must not be eaten solely because they have been seen or discussed during a session. Identification and consumption guidance relates to the specimen and circumstances being demonstrated; participants remain responsible for exercising appropriate care when foraging independently.

15. Corporate, school, youth-group and private bookings

The quotation and booking confirmation will set out the agreed date, approximate numbers, duration, venue, activities and price. Organisers must promptly notify us of material changes to participant numbers, ages, accessibility needs or other information relevant to safe delivery. Where numbers affect staffing, catering, materials, travel or venue costs, pricing may be based on an agreed minimum or confirmed number.

16. Photography and video

We may take photographs or video for legitimate business, record-keeping or promotional purposes where appropriate. Where consent is required, particularly for identifiable children or young people, we will seek appropriate permission. If you do not wish to appear in promotional photography, tell the instructor or organiser. Commercial filming or photography requires prior permission.

17. Personal belongings and damage

Participants are responsible for their belongings. We will take reasonable care but cannot accept responsibility for loss or damage not caused by our failure to exercise reasonable care and skill. We may seek the reasonable cost of repair or replacement where equipment or property is deliberately or negligently damaged, allowing for fair wear and tear.

18. Our responsibility to you

We will provide our services with reasonable care and skill. We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to exercise reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or to the extent it results from a participant ignoring clear safety instructions, deliberately misusing equipment or failing to disclose relevant information where that failure causes or contributes to the loss.

Our insurance is subject to its own terms, limits, conditions and exclusions and the existence of insurance does not alter either party’s legal rights or responsibilities. If you are a consumer, nothing in these terms limits your statutory rights.

19. Incidents and accidents

Any accident, injury, near miss, damage or other incident must be reported to the lead instructor as soon as possible. Participants and organisers should provide reasonable factual information needed to record and investigate an incident. We may retain incident, participant and supporting records where reasonably necessary for health and safety, legal obligations, insurance requirements and the establishment, exercise or defence of legal claims, as explained in our Privacy Policy.

20. New or changed activities

Activities offered by us are subject to our safety arrangements and insurance requirements. We may withdraw, replace or postpone an activity if required safety arrangements, instructor competence, risk assessment or insurance approval are not in place.

21. Events outside our reasonable control

We will not be responsible for delay or failure caused by events genuinely outside our reasonable control, such as extreme weather, fire, flood, government or emergency-service restrictions, venue closure or serious transport disruption. We will take reasonable steps to minimise the effect and communicate with affected customers. Refund or alternative arrangements will depend on the circumstances and applicable law.

22. Complaints

If something is wrong during an activity, tell the lead instructor as soon as possible so we can try to resolve it. Otherwise contact info@devonandcornwallbushcraft.co.uk with your booking details and a clear description of the issue. We will investigate and respond within a reasonable time.

23. Personal information and records

We process booking, participant, medical/suitability, safety and incident information to administer bookings and deliver activities safely. Some records are required by our insurer to be retained and made available to insurers on request. Please see our Privacy Policy for the categories of information, purposes, lawful bases, retention approach, sharing arrangements and your data-protection rights.

24. Website content and intellectual property

Unless otherwise stated, website text, course materials, photographs, graphics and other original content produced by Devon and Cornwall Bushcraft may not be reproduced or used commercially without permission. This does not restrict lawful personal use or rights provided by law.

25. Changes to these terms

We may update these Terms & Conditions from time to time. The terms applying to a confirmed booking will normally be those in force when the booking was made, together with any later change required by law or expressly agreed with you.

26. Governing law

These terms are governed by the law of England and Wales. Consumers retain mandatory rights to bring proceedings in courts available to them under applicable law. If any part of these terms is invalid or unenforceable, the remaining terms continue to apply.
